AB 112 Local government: tobacco settlement.

An act to add Section 25350.2 to the Government Code, relating to local government.  

SECTION 1. Section 25350.2 is added to the Government Code, to read:  

25350.2. It is the intent of the Legislature in enacting this act that the 50 percent of the total recovery that is  

25350.2. (a) All of the total recovery money that is allocated to the cities and counties of California pursuant to the memorandum of understanding from the settlement of the coordinated tobacco litigation in the matter of Tobacco Cases I, Case Number 4041, Department 46 of the Superior Court, County of San Diego, be deposited shall be available to cities and counties for any purpose.  

(b) The governing body of a city, county, or city and county, may, by resolution, deposit those moneys in a special Tobacco Litigation Settlement Fund in the State Treasury to be used for both of the following:  

(a)  

(1) The principal and interest from the fund shall be available to cities and counties to guarantee payment under an agreement to finance capital improvements.  

(b)  

(2) Security for certificates of participation for local capital projects.
