AN ACT
Relating to basic breathing screening, with an expiration date.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section 1. 1. As used in this section, the following terms mean:
(1) "Basic breathing screening", pre- and post-exercising peak flow meter readings, or other technologies approved by the department of health;
(2) "School", all elementary and secondary schools;
(3) "School board", the governing body of any school.
2. Beginning January 1, 2001, every school board in this state shall provide basic breathing screening without charge to each second-grade and sixth-grade student in its school. All such tests shall be performed by a qualified health care provider designated by the school board. The results of the test and, if necessary, a recommendation for examination by a physician shall be reported to the parents or legal guardians of such students.
3. Every school shall provide each student receiving the basic breathing screening with educational materials on smoking prevention, including secondhand smoke.
4. The school boards shall report annually to the department of health the number of students receiving the basic breathing screening and the numbers referred for examination by a physician. The department of health shall present a report of the basic breathing screening to the general assembly in January, 2004.
5. The requirements of this section shall not apply to any child who has had a basic breathing screening examination within six months of the screening conducted by the school.
6. The basic breathing screening shall be funded by any tobacco settlement moneys received by the state.
7. The provisions of this section shall expire on June 1, 2004.
