                                     AN ACT



     1  Providing for the disposition and appropriation of moneys

     2     received by the Commonwealth from the tobacco litigation

     3     master settlement agreement.



     4     The General Assembly of the Commonwealth of Pennsylvania

     5  hereby enacts as follows:

     6  Section 1.  Tobacco litigation settlement funds.

     7     (a)  General rule.--All funds received by the Commonwealth

     8  under the tobacco litigation master settlement agreement shall

     9  be deposited by the State Treasurer into a restricted receipts

    10  account within the General Fund for subsequent annual

    11  appropriation by the General Assembly.

    12     (b)  Appropriations by General Assembly.--Annually all moneys

    13  received by the Commonwealth under subsection (a) shall be

    14  appropriated by the General Assembly as follows:

    15         (1)  One-third shall be appropriated for school funding

    16     for special education reimbursement within this Commonwealth.

    17         (2)  One-third shall be appropriated for Open Space and

    18     Greenway Trails within this Commonwealth.



     1         (3)  One-third shall be appropriated to cancer research

     2     facilities and substance abuse treatment facilities within

     3     this Commonwealth.

     4     (c)  Definition.--As used in this section, the term "tobacco

     5  litigation master settlement agreement" means the master

     6  settlement agreement relating to tobacco litigation entered into

     7  in 1998 by the Commonwealth and leading United States tobacco

     8  product manufacturers.

     9  Section 2.  Effective date.

    10     This act shall take effect immediately.
